In these Terms and Conditions:
“Progressive Xpress,” “we,” “us,” or “our” refers to Progressive Xpress, a courier and freight-forwarding service operating in Jamaica.
“Customer,” “you,” or “your” refers to any individual or entity using our services.
“U.S. Address” refers to the shipping address provided by Progressive Xpress for receiving customer packages in the United States.
“Package” refers to any item shipped to our U.S. warehouse on behalf of a customer.
“Services” refers to freight forwarding, package consolidation, and shipping from the United States to Jamaica.
Progressive Xpress provides a freight-forwarding and courier service, which includes:
Issuing customers a U.S. shipping address
Receiving packages at our U.S. warehouse
Consolidating packages where applicable
Shipping packages from the United States to Jamaica three (3) times per week
Progressive Xpress does not sell goods, does not act as a retailer, and does not control third-party merchants, shipping carriers, or customs authorities.
Customers must register to receive a U.S. shipping address.
The U.S. address is provided solely for shipping purposes.
Use of the address for fraudulent, illegal, or misleading purposes is strictly prohibited.
Progressive Xpress reserves the right to suspend or terminate accounts that misuse the service.
Customers may not ship items prohibited under U.S. law, Jamaican law, airline regulations, or customs rules, including but not limited to:
Illegal drugs or controlled substances
Weapons, ammunition, or explosives
Hazardous materials
Counterfeit goods
Perishable or biological items (unless approved in writing)
Progressive Xpress reserves the right to refuse, return, destroy, or surrender prohibited items to authorities without liability.
Packages are handled with reasonable care.
Consolidation is offered at the customer’s request or where operationally appropriate.
Progressive Xpress is not responsible for manufacturer packaging quality.
Customers acknowledge that consolidation may involve repacking.
Shipments from the USA to Jamaica occur three (3) times per week.
Delivery timelines provided are estimates only, not guarantees.
Delays may occur due to weather, customs inspections, airline schedules, or force majeure events.
Customers are solely responsible for all customs duties, taxes, GCT, brokerage fees, and government charges in Jamaica.
Progressive Xpress does not control customs clearance decisions or timelines.
Accurate declarations and invoices must be provided by the customer.
Failure to pay applicable charges may result in shipment delays or storage fees.
Shipping fees are calculated based on weight, dimensions, and service type.
All fees must be paid before release of packages.
Prices are subject to change with reasonable notice.
Storage fees may apply to uncollected packages after a specified period.
Progressive Xpress shall not be liable for delays or service failures caused by events beyond reasonable control, including but not limited to:
Natural disasters
Acts of government or customs authorities
Airline or transportation disruptions
Labor disputes
Progressive Xpress’s liability, if any, is limited to direct loss only.
We are not liable for indirect, consequential, or special damages.
Liability is limited to the lesser of:
The declared value of the package, or
A reasonable freight forwarding compensation amount
Customers are encouraged to obtain third-party insurance for high-value items.
Claims for loss or damage must be submitted in writing within 7 days of package receipt.
Supporting documentation (invoice, photos, tracking details) is required.
Claims submitted outside this period may be rejected.
Progressive Xpress does not automatically insure shipments.
Insurance, if available, must be requested and paid for separately.
Coverage terms are subject to insurer conditions.
Customers agree to:
Provide accurate shipping and customs information
Comply with all applicable laws
Pay all fees promptly
Collect packages within the specified timeframe
Failure to comply may result in suspension or termination of services.
Progressive Xpress reserves the right to:
Suspend or terminate services for breach of these Terms
Refuse service where legal or operational risks exist
Unused balances, if any, will be handled in accordance with Jamaican consumer law.
Progressive Xpress handles personal data in accordance with Jamaican data protection principles. Customer information is used solely for service delivery, compliance, and communication purposes.
All website content, logos, branding, and materials are the intellectual property of Progressive Xpress and may not be used without written consent.
Customers agree to indemnify and hold harmless Progressive Xpress from claims, penalties, or damages arising from:
False declarations
Prohibited items
Breach of these Terms
Nothing in these Terms excludes rights granted under Jamaican consumer protection laws.
Where liability cannot be excluded by law, it shall be limited to the maximum extent permitted.
These Terms are governed by the laws of Jamaica.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Jamaica.
Progressive Xpress may update these Terms from time to time. Updated versions will be posted on our website and become effective upon publication.
